By accessing or using SwiftXTrading ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
2. Description of Service
SwiftXTrading provides a desktop trading platform that connects to your brokerage accounts and offers tools for market analysis, strategy development, and trade execution. The Platform is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the service at any time.
3. User Responsibilities
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Accuracy of Information: You agree to provide accurate and current information when creating your account.
Compliance: You agree to comply with all applicable laws and regulations when using the Platform.
Trading Risks: You acknowledge that trading involves substantial risk of loss and you are solely responsible for all trading decisions made using the Platform.
4. Trading Disclaimer
IMPORTANT: Trading securities, options, and other financial instruments involves risk of loss. Past performance is not indicative of future results. SwiftXTrading is a software platform and does not provide investment advice or recommendations. We are not a broker-dealer and do not execute trades on your behalf.
5. Broker Integration
SwiftXTrading integrates with third-party brokerage services. Your relationship with your broker is governed by your broker's terms of service. We are not responsible for your broker's actions, fees, or policies.
6. Fees and Billing
Subscription fees are charged in advance on a monthly or annual basis depending on your selected plan.
All fees are non-refundable except as required by law or as explicitly stated in our refund policy.
We reserve the right to change our pricing with 30 days notice to existing subscribers.
7. Intellectual Property
All content, features, and functionality of SwiftXTrading are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the Platform.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SwiftXTrading SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
9. Termination
We reserve the right to terminate or suspend your account at any time for violation of these Terms or for any other reason. You may cancel your subscription at any time through your account settings.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
